TERMS OF SERVICE

General- By commissioning me, you are agreeing to my Terms of Service.- Commission(s) may NEVER be used as NFTs or for the promotion of NFTs.- Before proceeding further, please note, that the commissions listed on this website are for personal use only. If you are unsure how you can and cannot use the commissioned piece, please see section 6 of the terms of service labeled "Rights."- Please note that all commissions can be credited to my Twitter handle (@Coelacanthts) when possible. This is not required, but appreciated.- I have the right to refuse service for any reason I see fit without explanation.- If you are commissioning me, you are agreeing that you are in search of an illustration that falls in line with my past work, my style of drawing, and its quality.1. Communication- When contacting me with a commission request, please send a proposal (i.e., a Google doc or email) that includes· What type of art you are looking for (Render style, Bust, Full Body, Chibi, Commercial etc.)· specifics for the piece (visual references for the characters, poses, expressions etc.)· and anything else you see fit (mood boards, character’s interests/personality etc.)It also helps if you attach any of MY work that you are drawn to. This allows me to try and replicate what you might find interesting in my work.- Your proposal should also include your PayPal email and contact information.- I will send you a payment invoice once the commission is approved.- Please note that I currently work a demanding full-time job. Commission wait time may vary from 1 week to 2 months. If you have a deadline in mind, please mention it in your commission request.- I work better when left to myself. I will update you on my progress and also if I have any questions while I'm working. If you are wondering about the state of your commission, please refer to my Trello page ( https://trello.com/b/l2B58xc3/coelas-commissions-board ) before contacting me.- Be aware, that because I work late hours, if you do need to contact me, it may take me upwards of a day to reply.2. Process- When commissions are OPEN, please message me on Twitter, Reddit, Instagram or Discord to request a commission.- Commission slots are confirmed once full payment is received through PayPal. I do not add people to the queue until commissions are paid in full. If your piece exceeds $150, I accept payment in half installments. One is due before I begin while the other is due after the sketch is approved.- Once your sketch is finished, I will send a watermarked copy to be approved. Once reviewed, I will make changes up to 3 times. I will NOT proceed with a commission until I receive expressed approval of the sketch.- Once the commission is done, I will send a signed and unsigned version in whatever file type requested. If you are going to share the commission on social media, I request you only share your signed version. The one without a signature is for personal use only.3. Payment/returns- Payment is to be sent in full by PayPal before work on your commission begins. Again, I will NOT add commissions to my queue until they are paid for in FULL.- If your commission exceeds $150 I will consider accepting half payment before I begin, and half payment once the sketch is completed.4. Add-ons- Commission pricing does not include backgrounds. I will draw simple or detailed backgrounds for an additional price upon request. I will add a color background for free if requested, otherwise all illustrations come with a transparent or white background.- Characters with excessive details or added props may also receive an additional charge.- Adding another character to your illustration will be an additional charge.5. Refunds/cancelation- I may cancel your commission at any point of the process. If I initiate a cancellation, I will refund the commission in full.- Commissions canceled before I have begun working on them will receive a full refund.- Commissions canceled after I have begun the sketching process are only eligible for a partial refund of 50%- Once a commission sketch has been finished and approved, I no longer accept cancelations.- Refunds will only be paid back to the account which originally sent payment. I will not refund to other PayPal accounts.6. Rights- These commissions are for personal use only, meaning they cannot be used for resale, product design or any form of monetary gain.- Commissioners hold the right to share commissioned pieces and use the art for personal promotion.- Commissioners are granted permission to perform MINOR edits on pieces, such as cropping or filter adjustments, however, this does not grant commercial rights. Edited work is not permitted to be used for monetary gain.- Commissioners are granted the right to use their commission as an icon, banner, stream assets, emotes or announcement images. Credit is appreciated.- Commissions are allowed to be printed for personal purposes. For example, if you would like to have a copy for your room, print a sticker, and/or any other printing that is not meant for distribution or resale, you have the right to do so.7. Artist rights- As the artist, I retain all rights to my illustrations.- I may use your commission for posting, promotion, marketing, streaming, portfolios/references, and also mass printing.- If your commission is private, please let me know. As long as this is properly communicated I will not post or mention your commission.8. Commercial use- If you would like to commission me for commercial pieces, please email me ([email protected]) or message me on your preferred platform with the associated project proposal. You may also contact me about buying the commercial rights to an existing commission, so that it may be used for any sort of commercial use (i.e., merch, mass printing)
